CONSTITUTION OF THE ASSAM UNITED DEMOCRATIC FRONT

Article:- I
The name of the party shall be as the "ASSAM UNITED DEMOCRATIC FRONT" (AUDF). In regional language, "Asom Sanyukta Ganatantric Marcha".

Article-II
The "ASSAM UNITED DEMOCRATIC FRONT" is a political platfrom i.e. a political party and a progressive movement of all section of people- ethnic, religious or linguistic.

Article- III

The head office of the the "ASSAM UNITED DEMOCRATIC FRONT" shall be located at Gauhati City, place shall be determined by the executive body of the "Assam United Democratic Front". That the state executive committee shall have the right for the convinience of work or for any other emergent reasons to shift the head office from Gauhati city to any other place but that should be located within the state.
Article- IV
The "ASSAM UNITED DEMOCRATIC FRONT" shall bear true faith and allegiance to the constitution of India and to the principles of Socialism, Secularism and Democracy and would up-hold the sovereignty, Unity and Integrity of the Union of India.

Ariticle- V
The "ASSAM UNITED DEMOCRATIC FRONT" shall bear the true faith and allegiance to the constitution of India. And would uphold the sovereignity, unity and integrity of India. The Assam United Democratic Front shall maintain and uphold the principles of Secularism, Socialism and Democracy. That regional disparity, in the share of development, and the disparity amongst the ethnic groups, religious minorties and linguistic minorites, in sharing the fruits of devlopment becomes threat to the unity and integrity of our country as well as the state of Assam. Hence, the "ASSAM UNITED DEMOCRATIC FRONT" aims for equal devlopment among all sections of people, irrespective of caste, creed, ethnocity and religion and also for equal devlopment in all regions of Assam, particularily, it aims for establihing "Social Justice amongst all sections of people".

Article-VI- OBJECT :
(a) To work within the framework of the constitution of India.
(b) To work for political, social, economical, educational, cultural,and genral well-being of the people of the country, particularly of the state of Assam, with an ideology of social justice, Secularism and Democracy.
(c) To work for the well-being of all exploited classes of people including all ethnic groups of Assam, all religious and linguistic minorities and to cultivate and enhance brotherly feelings and amity amongst all sections of people of Assam as well as India.
(d) To stand behind the oppressed people and to render them all possible help to fight for their cause and sufferings.
(e) To Co-operte with other like minded political parties of Assam or to make an aliance with other political parties, at any appropriate time, as decides by the executive committee of the "ASSAM UNITED DEMOCRATIC FRONT"
(f) To stand for the equality,unity and fraternity of all irrespective of caste, creed Community, religion and sex.
(g) That the "ASSAM UNITED DEMOCRATIC FRONT" will try to create leaders of high morals and efficency and will try to solve all burning problems and issues of Assam.
(h) That the "ASSAM UNITED DEMOCRATIC FRONT" shall strive for reflecting the population pattern in all employments, admission in higher studies, Medical, Engineering and all other technical education and also for oppurtunities in all other sphere.

Article-VII : TERRITORIAL JURISDICTION :
The "ASSAM UNITED DEMOCRATIC FRONT" shall comprise the state of Assam and each and every adminstrative sub-division shall be deemed to be a district for the purpose of this Constitution.

Article-VIII : FLAG :
The Flag of the the "ASSAM UNITED DEMOCRATIC FRONT" shall consist of 3(Three) horizontal Colours; Green(Upper); white (middle); and Black (bottom).
Black signifies deprivation and oppression; white signifies resque from deprivation and salvation; and green signifies peace and progress.
Size:
Length : Not less than 75 C.M.
Breadth : Not less than 50 C.M
Length : Breadth= 3 : 2

Article- IX : DEFINATIONS :
In this Constitution, unless the context otherwise requires.
(a) Constitution means the constitution of or rules and regualtions for the "ASSAM UNITED DEMOCRATIC FRONT"
(b) Bye-Law means the Bye-laws framed by the state Executive Committee of the "ASSAM UNITED DEMOCRATIC FRONT"
(c) Law means Election manual of the Election Commission of India.
(d) Front, means the "ASSAM UNITED DEMOCRATIC FRONT".
(e) 'Year' means the English Calender Year.

Article- X : ORGANISATIONAL STRUCTURE :
(A) MEMBERSHIP:
(a) Primary members.
(b) Active members.
(a) Primary members :
Any person who is an Indian citizen and has completed the age of 18 years and subscribes to the memorandum, rules and regulations of the constitution of the "ASSAM UNITED DEMOCRATIC FRONT" and who is not a member of any other political party or communal organisation shall be elligible to become a member of the "Assam United Democratic Front" on making a written declaration in the prescribed form vide Appendix-1 and on payment of annual subscription of Rs.2/-(two) only.
(b) Active members :
A Primary member of the front can be an active member on payment of Rs.5.00 only in addition to his primary membership fees of Rs. 2/-, after enrolling another 9 primary members and depositing Rs. 25 and on signing the active membership form vide Appendix-2.

B. ORGANISATIONAL STRUCTURE
The organisational Structure of the "Assam United Democratic Front" shall be as follows :
1. Central council.
2. State Executive Committee
3. District/City Committee
4. Constituency Committee
5. Primary Committee

C. FRONTAL ORGANISATION:
There shall be five frontal Organisations namely Assam United Democratic Youth Front (AUDYF), Assam United Democratic Woman Front (AUDWF), Char Parishad, Farmer's Front and Tea Garden Labourer's Front. Each front shall be nominated bodies to be nominated by the President in consultation with the General Secretaries and shall consist of office bearers as follows :
President - 1
Vice-President - 3
General Secretaries - 3
Secretaries - 3
Treasurer - 1
Members - 20

Article- XI :

A) PRIMARY COMMITTEE :
(i) There shall be Primary Committee in each Gaon Panchayat and Municipalities/Towns; the Primary Committees shall be constituted as follows :
(ii) The Priamry Committee shall consisit of at least 200 primary members. The Primary Committee shall elect a Primary Executive Committee with 11(eleven) mebers including the following office bearers:
President - 1
Vice-President - 2
Secretary - 1
Assistant Secretary - 1
Treasurer - 1

(B) CONSTITUENCY COMMITTEE :
All Presidents and Secretaries of the Primary Executive Committee falling under the jurisdiction of a legislative Assembly Constituency shall form the Constituency Committee. The members of the Constituency shall elect a Constituency Executive Committee with the following Office bearers.
President - 1
Vice- President - 2
General Secretary - 1
Secretaris - 2
Treasurer - 1
Auditor - 1
Members - 11

(C) DISTRICT/CITY COMMITTEE:
(i) There shall be a District Committee immediately below the State Executive Committee ordinarilly Co-terminus with the adminstrative boundary of every civil Sub-division. But in case of the Guwahati District Committee the area included in the Guwahati Municipal Corporation shall from the Guwahati City Committee.
(ii) The District /City Committee shall consist of :
(a) Presidents and General Secretaries of the Constituency Committees.
(b) Five members elected by each constituency committee from amongst themselves or from the active members of the Constituency.
(c) Ex-Presidents of the District Committee provided they are active members of the front.
(d) Members of the State Executive Committee who reside in the concerned District.
(e) Members of the Legislative Assembly and parliament, elected from the concerned district.
(f) Five members to be co-opted of whom two shall be female.
The district/City Committee shall be formed in a meeting of the presidents and General Secretaries of each Primary/Town Executive Committee and Constituency Committees. The meeting shall be convened by a convenor to be nominated by the president of the State Executive Committee.

(D) DISTRICT/CITY EXECUTIVE Committee:
i) The members of the District/City Committee shall form a District Executive Committee with not more than 31members from amongst themselves with the following Office bearers:
President - 1
Vice-President - 4
General Secretary - 1
Secretaries - 3
Treasurer - 1
Auditor - 1
Members - 20
ii) The District Executive Committee shall sit at least once in 3 months.
iii) The District Executive Committee shall be the Executive Authority of the Front within the District and shall be responsible for carrying out the policy and programme laid down by the State Executive Committee from time to time.

(E) STATE EXECUTIVE COMMITTEE :
i) The Central Council shall elect the State Executive Committee in the General Conference of the Front with 41 members from amongst themselves with the following office bearers.
President - 1
Vice-President - 5
General Secretaries - 5
Secretaries - 6
Office Secretary - 1
Treasurer - 1
Auditor - 1
Members - 21
ii) The President, Vice-Presidents and Treasurer shall be elected by the Central Council. All other office bearers and members of the State Executive Committee shall be appointed by the President in consultation with Vice Presidents.
iii) Members of the legislative Assembly and parliament will be the ex-officio members of the State Executive Committee.
iv) Presidents and General Secretaries of all the District/City Committee shall be permanent invitees to the State Executive Committee.
v) Any active member of the front may be invited to attend the State Executive Committee meeting as special invitee.

(F) CENTRAL COUNCIL :
There shall be a Central Council to aid and advise the State Executive Committee.
The Central Council consists of :
(i) President and Genral Secretaries of all the District/City Committees.
(ii) 5 members elected by each District/City Committee form amongst themselves or form the active members of the District.
(iii) Members of the Legislative Assembly and Parliament.
(iv) 2 additional members/elected by the District Executive Committee from amongst the unrepresented section of which two shall be women.
(v) Ten members to be co-opted by the State Executive Committee to the council.
(vi) The President of the State Executive Committee shall convene the meeting of the Central Council at least once in every year. The meeting of the Council shall be convened by the president if 30% members of the Council submit a written requistion with specified agenda at least one month before the proposed meeting.

Article- XII : POWERS AND FUNCTIONS OF THE CENTRAL COUNCIL:
(i) The Central Council may form an Advisory Board consisting of not more than 5 members, specially of Senior aged and experienced members.
(a) To aid and advise the State Executive Committee.
(b) Resolve any dispute or deadlock in the party.
(c) In case of any dispute on any issue the Central Council and/ or the State Executive Committee may refer the matter to the Advisory Board for opinion and advice.
(d) Take any decision to meet an emergency in the interest of the party subject to approval by the the State Executive Committee. The mebers of the Advisory Board shall be ex-officio mem bers of the Central Council and the State Executive Committee.
(ii) The Central Council shall be the appellate authority and as appellate authority the Central Council shall have the powers to confirm/annual/modify/vary the decision of the State Executive Committee referred to it.
(iii) The Central Council shall have the power to take up suomotu any issue for decision if it thinks so fit and proper in the interest of the Front.
(iv) The Central Council shall have the power to amend the Constitution of the front by two-third majority, present in the meeting.
(v) This advisory Board of the Front, shall have an important function of organising and impart moral and value-based education time to time, among the leaders, workers of the Front as well as among the mass people to boost of values and morale.
iii) VACANCY :
Any Vacancy caused in any way during the life of a Committee in any elected body of the Front shall be filled up by the respective Committees by Co-option.
iv) NOTICE:
Three weeks notice shall be given for the meeting of Central Council. 15 days notice shall be given for the meeting of Committees of all level. In case of emergency 3 days notice will be sufficient.
v) PERIOD OF MEETING:
There shall be meeting of all level Executive Committees once in every three months.
vi) REQUISITION MEETING :
A requisition meeting may be held if 30% of the total members of any committee submit a Written application to the President. Such requisition shall specify the purpose for which the requistionists desire a meeting. A requisition meeting shall be held within one month of the receipt of the requisition.
vii) ADJOURNMENT :
Adjournment where a quorum is not present :
If within an hour's time from the time appointed for the special conference the quorum is not present, the meeting is called upon by the requisitionists shall stand dissolved. In all other cases if the quorum is not present, the meeting shall be adjourned to another convenient day as decided by the President but if in the adjourned meeting also a quorum is not present within 15 minutes, the Members present shall form the quorum and will precede to contract the business.
Adjournment where a quorum is present : The President may with the consent of the members present at which a quorum is present adjourn the meeting from time to time and from place to place. The President may also adjourn the meeting in his own capacity if there is noisy scenes cannot be controlled immediately.

Article- XIII : POWERS AND FUNCTIONS OF THE STATE EXECUTIVE COMMITTEE :
(i) The State Executive Committee shall be the highest Executive Authority of the Front and shall have the Power.
(a) To frame Rules for the proper working of the front.
(b) To issue instructions not inconsistent with this Constitution and frame rules in all matters not otherwise provided for :
(c) To superintend, direct and control all Subordinate committees and the Reception Committees:
(d) To take such disciplinary action as it may deem fit against any member / members of the state Executive Committee; and all other Subordinate Committees.
(e) To take such action or actions in order to meet an emergent situation in the interest of the Front.
(f) To fill up the Vacancy if any, in the office bearers of the Executive Committee by Co-Option.
(g) To appoint Returning Officer for conducting Organisational elections of the State Executive Committee.
(h) To appoint observers in connection with formation of District and Constituency Committee.

Article- XIV : ELECTION OF LEADER AND OTHER OFFICE BEARERS OF LEGISLATURE PARTY:
The State Executive Committee shall elect the leader, Deputy Leader, Chief whip, Whip and Secretary of the Legislative party of the Front .
The state Executive Committee shall have also the power to suspend, expel or take any action deemed necessary in respect of the Office bearers of the Front in accordance with the Provisions laid down in Article -XIX of the Constitution of the Front.

Article- XIV

(A) POWER AND FUNCTION OF THE PRESIDENT:

The President of the state Executive Committee Shall be the Executive Head of the Front and shall have the Power.
i) To preside over all the meeting of the Executive Committeeas wellas the Central Council.
ii) To suspend / dissolve any committee subordinate to the State Executive Committee subject to the approval of the State Eexecutive Committee.
iii) To suspend any of his office bearers if there is a prima -facie breach of discipline. The Presidentshall place the matter before the State Executive Committee or the Central Council which will sit earlier for approvals. The committee shall take final decision on the matter of suspension. The President shall give due opportunity to the person concerned to explain his conduct. He is however, debarred from taking any action while the Central Council or the State Executive Committee is in session.
iv) To issue any instruction to the subordinate committee and members of the Front.
v) To convene the meeting of the Central Council.
vi) The President may appoint any member of the party of his choice, to act as working president subject to the approval of the State Executive Committee.

(B) POWERS AND FUNCTIONS OF THE VICE -PRESIDENT:
(i) The Vice-Presidents shall have the same power and functions as that of the President in the absence of the President.
(ii) In case the post of president fall vacant due to death or resignation or other wise one of the Vice-presidents shall act as president .

(C) POWERS AND FUNCTIONS OF THE SECRETARIAT :
The Secretariat shall consist of the General Secretaries and Secretaries. That the General Secretaries shall have the powers :
(i) To convene the metting of the State Executive Committee in consultation with the President .
(ii) To look after the administrative and organisational matters.
(iii) To maintain records, files and registers of the Front.
(iv) To implement decisions of the State Executive Committee and the Central Council.
(v) To maintain accounts and submit an Audited account and a statement of activities to the State Executive Committee and Central Council every year.
(vi) To undertake all such activities as may further the aims and objects of the Front in consultation with the President and in absence of the President with Vice President in writing.
(vii) The General Secretary may entrust such powers and functions to the Secretaries as he deems fit and proper in consultation with the President for the smooth functioning of the Front.

(D) POWER AND FUNCTIONS OF THE TREASURER :
The Treasurer shall be in-charge of the funds of the Front and shall keep proper account of all invesments, income and expenditure.

Article- XV : CEASATION OF MEMBERSHIP / TERMINATION AND RESIGNATION
i) A member or the Organisation shall cease to be a member on account of death, resignation, Physical or mental inability, termination of Primary membership of on being convicted by a court of law for an offence involving moral turpitude.
ii) Any member of the party has the right to resign the Primary membership and the letter of resignation should be submitted to the President.
Article- XV(A) : NO CONFIDENCE :
Any member may move ''No Confidence Motion" against any elected office bearer of the Committee to which the mover belongs, if his motion is supported by 1/4th members of the respective Committee, had it shall be carried out the option / votes of two-third majority of the members present or 51% of the total numbers of the respective Committees whichever in favour of the motion.
(B) The noticeof "No Confidence Motion" shall be submitted to the President if it is against any office bearer other than the president and if it is against the President. It is to be submitted to the Vice President who will convene the meeting for the purpose within two weeks from the date of receipt of the notice.

Article -XVI : RENEWAL OF MEMBERSHIP :
Membership of the Front may be renewed by filling up the Membership Renewal Form .

Article -XVII : REGISTER OF MEMBERS :
There shall be permanent Registers of all classes of members separately which shall contain the full name, address, age, occupation, place of residence and date of enrolment of each member. The registers shall be maintained by the District executive Committee and a Copy of each Register duly certified by the President of the District Executive Committee shall be made available to the state executive Committee of the Front.

Article -XVIII

(i) LIFE OF A COMMITTEE :
An elected committee of all level of the Front shall be for a period of two years from the date of formation and shall continue till a new committee is formed .

(ii) QUORUM :
The Quorum of the State Executive Committee and Central Council will be one-fourth of its members. Quorum of the District Executive Committee, Constituencey Committee, Gaon Panchayat Committee, Town Executive Committee shall be with the Presence of 1/3 members.

Article- XIX : FUND
a) The funds of the front or any of its subordinate bodies shall be deposited in a scheduled Bank which will be operated by the Joint siganture of the President and Treasurer or by the General Secretary and Treasurer as the case may be:
b) The President and the Treasurer or the General Secretary and the Treasurer shall have the power to open account with the bank and make all payments on behalf of the Front and to receive any amount for the Front.
c) The State General Secretary and District Secretary may keep with them an impress cash of an amount not exceeding Rs.3,000/- and Rs.1,000/- respectively. In case of constituency Committee, Panchayat and Town Committee the Secretary may retain an impress fund of Rs. 1,000.00 only.

Article-XX : DISCIPLINARY ACTION AGAINST MEMBERS:
a) Subject to the provisions of clause of these rules any person enrolled by a Branch of the Front as a member thereof including office bearers working against the interest of the Front or in violation of the Rules or Discipline of the Front or working in such a way as to lower the Front in public estimation shall be liable to be expelled by the relevant District Executive Committee. The said District Executive Committee may take action Suo-moto or on a complaints from any unit of the Front. No action shall be taken without following member concerned to be heard in defence and the reasons of the expulsions must be recorded in writing. The order of the expulsion shall be subject to right of appeal to the State Executive Committee whose decision shall be final in the matter.
(A) ACTION BY THE STATE EXECUTIVE COMMITTEE:
The State Executive Committee may also take Suo-moto disciplianry action against any office bearer or member of the Front on any of the grounds mentioned above including the members of the State Executive Committee after hearing the party concerned in self defence and its decision recorded in writing shall be final in the matter, subject to the right of appeal to the Central Council.
(B) THE MANNER OF DECIDING QUESTIONS IN CONFERENCE OR MEETING:
(i) Every delegate shall have one vote.
(ii) All questions shall be determined in the meeting by majority of votes of the delegates present.
(iii) In case of equality of votes the President shall have power to exercise casting vote.
(C) CONCLUSIVENESS OR RESOLUTIONS:
(i) Any meeting unless a poll is demanded by any member, a declaration by the president of the meeting that the resolution has been carried and an entry to that effect in the proceeding book shall be evidence of the fact.
(ii) If a poll is demanded, the same shall be taken in a manner in accordance with the option of the majority of the members present and the result of the poll shall be deemed to be the resolution of the meeting at which the poll is demanded.
(iii) The resolution accepted at each meeting and the other business transacted shall be written either by the General Secretary or any of his Assistants in the proceeding Book and as soon as the president puts his signature therein, it shall be conclusive evidence that the proceedings of the meeting have been correctly written.
b) The District/City Executive Committee shall elect a District Election Committee with 5 members from amongst themselves. The District Election Committee shall recommend the names of three candidates for each constituency in order of preference to the State Election Committee for the purpose of making final selection of the candidate for the Central and State Legislatures. The final selection shall be made by the State Election Committee on the basis of the report of observers appointed by the State Election Committee or otherwise as it deems fit and proper.
c) The State Election Committee shall frame rules to give guidance to the District Election Committee in regard to the District Election Committee in regard to the recommendation of candidates and other matters relating to the conduct of elections.

Article- XXI

(A) RECEPTION COMMITTEE :
A Reception Committee shall be formed amongst the resident members of the place where the annual session of the Front has been decided to be held. The members of the District and the constituency Committee under whose jurisdiction the locality of the annual conference is situated will convene a meeting with the members and other invitees and will elect a chairman and other office bearers of the Reception Committee for holding successful conference.

(B) COMPOSITION OF ANNUAL CONFERENCE :
Beside the members of the Central Council the following categories of Members may be sent by the District Executive Committee and Constituency Committee as delegates to the Annual State Conference.
(i) 5 Delegates by each District Executive Committee.
(ii) 5 Delegates by each Constituency Committee.
(iii) Members of the State Executive Committee will be the Ex-officio members.
(iv) 5 members to be elected by the Reception Committee.
(v) Others can participate as observers subject to payment of usual charges through District and Costituency Committee.

(C) SUBJECT COMMITTEE :
(i) The Delegates from the District will elect or select one third of their members subject to a minimum of the subject committee.
(ii) The members of the outgoing State Executive Committee shall be ex- officio members.
(iii) 5 members to be selected or elected by the reception Committee .
(iv) M.L.As and M.Ps of the front are Ex- officio members of the subject Committee.

(D) MOVING OF RESOLUTION :
Any member on giving notice on any matter of the front shall table the same to the General Secretary at least 5 days ahead of the meeting, so that the said resolution or resolutions may be placed before the meeting of the Subject Committee which may accept or reject the same. In case of rejection the aggrieved member with the permission of the President may state before the meeting the purpose for which he wanted to move such resolution/resolutions. The conference can allow him, after hearing him, to move such resolution/resolutions.

Article- XXII : ANNUAL CONFERENCE:
The annual General Meeting of the Central Council will be held at least once in every year. The meeting of the Central Council will be convened with the State Conference to transact business of the following purpose.
1. To elect the office bearers of the State Executive Committee.
2. To examine the Draft Resolutions to be prepared by the subject committee.

Article -XXIII

(i) COMMON SEAL

There shall be common seal of the Front which shall be deposited with the General Secretary /Secretary for all the respective Committees.
(ii) The front may Sue /be sued in the name of its president /General Secretary.

(iii) PURCHASE OF LAND AND BUILDINGS :
On the strength of resolution of the State Conference the State Executive Committee may purchase, take on lease or accept any gift of any land buildings and may sell, let, exchange or otherwise transfer any propertyor any portion thereof, not required for that purpose or may develop any such property by constructing building thereon.

Article-XXIV : ELECTION MACHINERY :
a) The State executive Committee shall elect a State Election Committee consisting of the President, Vice President, the General Secretary and the Treasurer of the State Executive Committee, Leader of the Legislature party and seven other members elected by the State Executive Committee for the purpose of -
i) Making the final Selection of the candidates for State and Central Legislature; and
ii) Conducting election campaigns.

Article-XXV : POWER TO FRAME RULES :
The State Executive Committee may frame Rules and regulations in conformity with the provisions of the Constitution of the Front.
a) For giving effect to various provisions of this constitutions.
b) For conduct of organisational elections at different levels.
c) For proper working of the Front.

Article-XXVI : AMENDMENT OF THE CONSTITUITON OF THE FRONT :
i) Amendment to the Constitution of the Front can only be made at the Central Council meeting held on the occasion of the Annual Conference of the Front by two-third majority of those present and voting if necessary.
ii) The Central Council may effect any amendment to the constituiton in any meeting prior to the Annual conference if circumstance so demand by two-third majority of those present and voting if necessary, such amendment, however shall have to be ratified by the next Annual conference.

Article-XXVII : DISSOLUTION :
a) This Front is for mutual benefit of the members and the people they represent but not for gain or profit and no member shall be entitled to receive any proceeds upon its dissolution.
b) If upon winding up or dissolution of the Front as per law there remains, after the satisfaction of all debits and liabilities, any property what-so-ever, the same shall not be paid to or distributed among the members, but may be paid or distributed to institutions having similar obejct; but that will be determined by not less than 3/5th of the members of the Front present at the annual conference or in default thereof by a judge of a Competent Court.
